Plaintiff fell on a small patch of ice outside Defendant’s grocery store and suffered a trimalleolar fracture to her ankle. Plaintiff did not expect ice in the parking lot, as it had not rained or snowed in the weeks prior to her fall. After filing suit, Preuss Foster obtained evidence that Defendant’s property had a drainage issue that caused runoff water to pool, collect, and freeze at a specific portion of the parking lot. Press Foster was able to establish that Defendant knew of this dangerous and reoccurring condition and failed to remedy the condition.
