Our firm recently secured a $1.25 million settlement for a client who suffered a Traumatic Brain Injury (TBI) following a car accident.
The accident occurred when another vehicle violently struck the driver’s side of our client’s car. The impact threw our client across the vehicle, causing his head to slam into the passenger-side door. Plaintiff had an abrasion to the scalp with bleeding and swelling. Immediately following the impact, Plaintiff reported headaches, memory loss, balance issues, nausea, sensitivity to light, and sensitivity to sound. Following imaging of the brain, an aneurysm was detected at the same location of the head that our client struck. However, prior imaging showed a small, benign aneurysm existed before this crash. The defense and insurance carrier argued that the brain injury, specifically the brain aneurysm, was pre-existing and was not caused by this crash.
Preuss | Foster Law was able to retain an expert team of neurologists and neurosurgeons to opine that had the crash and trauma to the head never occurred, the need for a craniotomy and several additional brain surgeries would not have been needed. This expert team was able to provide evidence to the insurance carrier and defense that the pre-existing aneurysm was benign and was not at risk of rupturing. However, the shearing forces and blunt force trauma to the head traumatized the aneurysm, caused it to grow, and necessitated the need for the resulting surgeries.
